(a) Notwithstanding any provision of this chapter to the contrary, an application for transfer of ownership of a sexually-oriented business license from one person to another may be made to the licensing administrator. Such application shall contain such information as required by section 86-29 and subsections (a)(1) through (8) of section 86-549. In determining whether to approve a transfer of ownership, the licensing administrator shall consider only the requirements of sections 86-35 and subsection (1) and (2) of section 86-551.

(b) Upon motion of the licensing administrator or upon complaint, the director shall cause a hearing on the transfer of ownership application to be held. No such hearing shall be held until notice thereof has been provided to the applicant at least ten days prior to the scheduled hearing date.

(c) No license may be transferred when the director has notified the licensee that suspension or revocation proceedings have been or will be brought against the licensee. (Ord. No. 98-86, § 18, 11-30-1998)
