(a) If, after investigation, the licensing administrator finds, in addition to the findings required by section 86-35, that:

(1) The individual applicant, or each of the officers, directors, managers, partners, members, and/or principal owners of the applicant are 18 years of age or older;

(2) The individual applicant, or each of the officers, directors, managers, partners, members, and/or principal owners of the applicant have not been convicted of a specified criminal act or acts for which:

a. Less than two years have elapsed since the date of conviction or the date of release from confinement, whichever is the later date, if the conviction is of a misdemeanor offense;

b. Less than five years have elapsed since the date of conviction or the date of release from confinement, whichever is the later date, if the conviction is of a felony offense; or

c. Less than five years have elapsed since the date of conviction or the date of release from confinement, whichever is the later date, if the convictions are of two or more misdemeanors; and

(3) The use of the location identified in the license application as a sexually-oriented business complies with the location requirements set forth in section 86-556,

then he or she shall, within 30 days following receipt of the license application, issue a sexually-oriented business license to the applicant for use at the location identified in the license application as the situs of the business.

(b) If, after investigation, the licensing administrator finds, in addition to the findings required by section 86-35, that:

(1) The applicant is 18 years of age or older; and

(2) The applicant has not been convicted of a specified criminal act within the times set forth in subsection (a)(2) of this section,

then he or she shall, within 30 days following receipt of the license application, issue a manager's license to the applicant.

(c) The fact that a conviction is being appealed shall have no effect on disqualification of the applicant. Notwithstanding any provision of this chapter to the contrary, an applicant who has been convicted of a specified criminal act or acts may qualify for a sexually-oriented business or manager's license only when the time period required in subsection (a)(2) of this section has elapsed.
