(a) Definitions.

(1) The term "change order" shall apply to any modification of an existing contract.

(b) May not exceed appropriations. In no event shall any change order be approved where such change order would increase the total contract cost to an amount exceeding the funds appropriated by the city council.

(c) Authority to approve change orders. Subject to the limitation set forth in subsection (b) of this section, authority to approve change orders shall be as follows:

(1) Change orders for less than $50,000. For change orders of less than $50,000, by the purchasing manager or designee.

(2) Change orders for $50,000 or more. For change orders of $50,000 or more, by the city manager or designee. A "purchasing services weekly report of actions" of $50,000 or more will be forwarded to the council prior to approval. If council approval is desired, a councilmember will notify the city manager and the item will be placed on the council agenda.

(3) All change orders shall be reported in the "purchasing services weekly report of actions."

(4) Construction, design-build and construction manager/general contractor contracts. The above change order requirements shall not apply to the construction and design-build contracts for work required to complete the project. Change orders that exceed the contingency amount will be reported to city council in the "purchasing services weekly report of actions."

(d) Administrative orders. Change orders that are administrative in nature, such as a decrease in cost, change in performance time, etc., may be approved by the purchasing manager or designee.

(e) Request by councilmembers. Any councilmember can request that any change order be submitted for full council review and approval.

(f) Authority to execute change orders. The director of finance or designee shall have the authority to execute on behalf of the city all change orders approved pursuant to this section.
