(a) Authority. The director of public works is hereby authorized, upon the basis of parking management study or investigation, to issue permits for the parking of motor vehicles in designated areas to support the following programs:

(1) Neighborhood parking permit program;

(2) Commuter parking permit program;

(3) Employee parking permit program; and

(4) Special parking permit program.

(b) Rules and regulations. Pursuant to this section, the director of public works may post signs to limit the duration of parking and, upon application, shall issue permits in accordance with rules and regulations promulgated by the public works department as necessary for the application of this section. The rules and regulations may establish eligibility criteria, fees, limits on the number of permits issued, the establishment or termination of a parking permit area, and other requirements as deemed necessary.

(c) Required. No vehicle shall be parked on a public street or right-of-way in a public parking permit district without a valid parking permit or without adhering to posted signs. Permits issued under this section are valid for parking within the public right-of-way and within facilities owned, leased, operated or managed by the City. A violation of this subsection shall be a traffic infraction.

(d) Neighborhood parking permit program. The parking of motor vehicles may be restricted in residential areas for the purpose of accessing destinations in nearby commercial, industrial or institutional areas when such parking could:

(1) Cause hazardous traffic conditions in the residential areas;

(2) Produce unacceptable levels of auto emissions, noise, trash and refuse;

(3) Unreasonably burden residents of the area in gaining access to their residences; or

(4) Damage the character of those areas as residential districts and significantly diminish the value of property in those areas.

(e) Conflicting provisions. Permits issued pursuant to this chapter shall not violate, cancel, or set aside any other provisions of this Code, including any other provisions relating to parking within the City. (Ord. No. 2016-34, § 16, 8-8-2016)
