Unless otherwise stated, the provisions in this chapter are subject to all applicable definitions, defenses, and presumptions provided by the Colorado Criminal Code (C.R.S. § 18-1-101 et seq.). In addition, the following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Under color of official authority means when, in the regular course of assigned duties, a peace officer, firefighter, marshal, or detention officer is called upon to make and does make a judgment in good faith based upon surrounding facts and circumstances that an order or command should be given, an arrest made, or other action taken of those assigned duties.
