(a) Notwithstanding any provisions of this chapter to the contrary, a secondhand dealer license may be transferred from one location to another upon the approval of a transfer application by the licensing administrator. Such application shall be made to the licensing administrator on forms prepared by the licensing administrator. In determining whether to approve a transfer application, the licensing administrator shall consider whether the applicant has satisfied the requirements of section 86-35(b) with respect to the location of the licensed premises

(b) Upon motion of the licensing administrator or upon complaint, the director shall cause a hearing on the transfer application to be held. No such hearing shall be held until notice thereof has been provided to the applicant at least ten days prior to the scheduled hearing date.

(c) No license may be transferred when the director has notified the licensee that suspension or revocation proceedings have been or will be brought against the licensee. (Ord. No. 98-86, § 17, 11-30-1998)
