Sec. 86-517. Prohibited acts.
(a) No secondhand dealer shall enter into any sale or trade with any individual under the age of 18 years without the prior consent of the individual's parent or legal guardian. Such consent shall be given in writing and/or electronically on forms approved by the police department that shall contain the following information:
(1) The name, address, and date of birth of the seller or trader;
(2) The name, address, and date of birth of the parent or legal guardian of the seller or trader;
(3) The identification number from any of the following forms of identification of the seller or trader and his or her parent or legal guardian:
a. A valid Colorado driver's license;
b. An identification card issued in accordance with C.R.S. § 42-2-302;
c. A valid driver's license, containing a picture, issued by another state;
d. A military identification card;
e. A valid passport; or
f. An immigration registration card; and
(4) A declaration of the parent or legal guardian that he or she is the parent or legal guardian of the seller or trader and that the seller or trader has permission to enter into any sale or trade with the secondhand dealer identified on the form unless and until such permission is rescinded in writing by such parent or legal guardian.
(b) No secondhand dealer shall enter into any sale or trade with any individual appearing to be intoxicated or under the influence of drugs.
(c) It shall be unlawful for any secondhand dealer or any customer thereof to knowingly provide any inaccurate, false, or misleading information with respect to the record required by section 86-516(a).
(d) It shall be unlawful for secondhand dealers purchasing precious or semi-precious metals or stones to issue cash or coin as a form of payment. payments for this type of secondhand property shall be in the form of a check issued from the business only to the seller or trader of the property as defined in section 86-516(b) of this division.
