(a) The director may, on the motion of the licensing administrator or on complaint, suspend, impose a civil fine not to exceed the maximum fine penalty in section 1-13, or revoke a license if, after notice and hearing thereon, he or she finds that:

(1) The licensee has failed to pay all required fees;

(2) The licensee is overdue on his or her payment to the City of taxes, fines, or penalties assessed against or imposed upon such licensee in relation to the licensed business;

(3) The licensee has made any false statement in the license or renewal application as to any of the facts required to be stated in such application;

(4) The licensee has failed to comply with his or her duty under section 86-29(c) to supplement the license application;

(5) The licensee has failed to file such reports or furnish such information as required by the provisions of this code relating to such license;

(6) The licensee has refused to allow an inspection of the licensed premises as authorized by section 86-42;

(7) The licensee, or any officer, agent, or employee thereof, either knowingly or without the exercise of due care to prevent the same, has violated any of the terms and conditions placed upon a license or violated any of the provisions of this chapter, chapter 26 or chapter 6 relating to such license, or any rule or regulation promulgated pursuant thereto;

(8) Any fact or condition exists, which, if it had existed or had been known to exist at the time of the license or renewal application, would have warranted the director or licensing administrator in refusing to issue or renew such license;

(9) The licensee has failed to operate the licensed premises in accordance with any building, fire, health or zoning statute, code, ordinance, or regulation, whether federal, state, or local, said determination being based on an investigation by the department, division, or agency charged with enforcing said laws. In the event of such a violation, the director shall promptly notify the licensee of the violation and shall allow the licensee a 20-day period in which to correct this violation. If the licensee fails to correct the violation before the expiration of such 20-day period, the director shall forthwith proceed with the suspension or revocation of the license;

(10) The licensee has knowingly permitted or encouraged, or has knowingly and unreasonably failed to prevent a public nuisance within the meaning of section 62-26 from occurring in or about the licensed premises;

(11) The licensee, or any officer, agent, or employee thereof, has committed a criminal offense under federal, state, or local law in or about the licensed premises or in association with the operation of the licensed business for which a conviction has been obtained, or has knowingly permitted the same to be committed on such premises by any other person;

(12) The licensee has failed to appear upon a municipal court summons in violation of section 50-33 of this Code; or

(13) The licensee, or any officer, agent or employee thereof, has failed to obtain or renew a state professional or business license, or required registration, or if after obtaining or renewing such license or registration the license or registration is revoked, suspended, or surrendered.

(b) Nothing within this chapter shall authorize the director to suspend or revoke a license based solely upon consumer complaints about a business.

(c) If the director finds that the license should be suspended or revoked, the licensee shall be provided written notice of such suspension or revocation and the reasons therefor within 20 days following the date of the hearing or such other time as is specified by the provisions of this chapter relating to such license. Nothing in this section shall preclude the director from imposing a civil fine upon a settlement agreement with the licensee.
