(a) Eligibility rules for elected officials. Each elected official who is employed in covered employment on the effective date and each former elected official shall become eligible to participate in this plan on the later of the effective date or the date the individual is first elected to the city council or to the office of mayor. Each elected official who commences covered employment after the effective date shall become eligible to participate in this plan on the later of the date the individual commences covered employment or the date the individual is first elected to the city council or to the office of mayor.

(b) Eligibility rules for executive employees. Each executive employee who is employed in covered employment on or after January 1, 2000 shall become eligible to participate in this plan. Executive employees with no hours of service in covered employment after December 31, 1999 shall not be eligible to participate in the plan.

(c) Re-employment. An elected official who leaves covered employment shall, upon reentering covered employment, immediately become a participant. An executive employee who leaves covered employment shall, upon reentering covered employment, become a participant so long as such executive employee is participating in the money purchase plan for executive personnel as provided in Article IX.
