Any franchise related to any street, alley, or public place within the corporate limits of the City of Aurora shall be subject to the initiative and referendum powers reserved to the people under Section 1 of Article V of the Colorado Constitution. Such referendum power shall be guaranteed notwithstanding a recital in an ordinance granting such franchise that such ordinance is necessary for the immediate preservation of the public peace, health, and safety. Five (5) percent of the registered electors of a home rule city shall be required to order such referendum. If such a referendum is ordered to be submitted to the registered electors, the grantee of such franchise shall deposit with the city clerk the expense (to be determined by said city clerk) of such submission. Editor's note: Section 1 of Ord. No. 87-204, approved at a city election held Nov. 3, 1987, repealed former §§ 12-5 and 12-6 in their entirety and reenacted § 12-5 to read as herein set out. Former §§ 12-5 and 12-6 pertained to granting of franchises and derived from the original Charter, approved June 27, 1961.
