By virtue of article XX, section 6 of the state constitution, the city has all powers necessary, requisite or proper for the government and administration of its local and municipal matters, including the power to legislate upon, provide, regulate, conduct, and control the issuance, refunding and liquidation of all kinds of municipal obligations. In exercise of this grant of power, City Charter section 8-3 requires the city council to provide for the planning and supervision of a community recreation program and for equipping and maintaining city-owned or controlled parks, recreational areas, and facilities. Accordingly, the city council finds and determines that the City, by and through its parks and open space department, has historically provided and will continue to provide golf services by means of an enterprise, as that term is defined by state law. The city council further declares its intent that the City's golf enterprise be operated and maintained so as to exclude its activities from the application of article X, section 20 of the state constitution.
