(a) It shall be unlawful for any person to sell, serve, give away, dispose of, exchange or deliver or permit the sale, serving, giving or procuring of ethyl alcohol to or for any person under the age of 21 years of age or to a visibly intoxicated person or to permit any such person to participate in the sale or dispensing thereof.

(b) A parent or legal guardian of a person under 21 years of age or any natural person who has the permission of such parent or legal guardian may give or permit the possession and consumption of ethyl alcohol to or by a person under the age of 21 years of age, while such person is legally upon private property, as defined in section 94-314, with the knowledge and consent of the owner or legal possessor of such private property, if the parent or legal guardian is present during such possession or consumption. This subsection shall not be construed to permit any establishment which is or is required to be licensed pursuant to C.R.S. tit. 12, art. 46(C.R.S. § 12-46-101 et seq.), tit. 12, art. 47(C.R.S. § 12-47-101 et seq.) or tit. 12, art. 48(C.R.S. § 12-48-101 et seq.) or any members, employees or occupants of any such establishment to give, provide, make available, or sell ethyl alcohol to a person under 21 years of age.
