(a) Permit required. It shall be unlawful to hold any outdoor meetings on public property, to which the general public is invited or permitted to attend, addressed by one or more speakers (expressive activity), or conduct a processional parade, unless a permit for such event has been issued by the chief of police and the city manager pursuant to section 146-207 for use of a public roadway, or the director of parks and open space for the use of other public property, as stated in this subsection. The permit shall be granted if it is found that the proposed use will not violate any laws, ordinances, rules, or regulations, and will not endanger public health.

(1) Application for use of a park, recreation area, or other public property for a rally, meeting, or other expressive activity shall be made to the parks and open space department at least 21 days prior to the event, with a copy sent to the police department, and shall contain the following information:

a. A description of the event.

b. The day, hour, and length of the event.

c. Location of the event.

d. A reasonable and good-faith approximation of the number of persons expected to attend the event.

e. The name, address, and telephone number of the person conducting the event.

f. If the rally, meeting, or other expressive activity is proposed to be conducted for, on behalf of, or by an organization, the name, address, and telephone number of the headquarters of the organization and of the authorized and responsible heads of such organization.

(2) The application for a parade permit shall be submitted to the chief of police no later than 21 days prior to the event and shall set forth the following information:

a. The name, address, and telephone number of the person seeking to conduct the parade.

b. If the parade is proposed to be conducted for, on behalf of, or by an organization, the name, address, and telephone number of the headquarters of the organization and of the authorized and responsible heads of such organization.

c. The name, address, and telephone number of the person who will be the parade chairperson and who will be responsible for its conduct.

d. The date when the parade is to be conducted.

e. The route to be traveled, including the starting point and the termination point.

f. The approximate number of persons who and animals and vehicles which will constitute the parade, the type of animals, and description of the vehicles.

g. The hours when the parade will start and terminate.

h. A statement as to whether the parade will occupy all or only a portion of the width of the streets proposed to be traversed.

i. The location by streets and addresses of any assembly areas.

j. The time at which units of the parade will begin to assemble at the assembly area.

k. The interval of space to be maintained between units of the parade.

l. If the parade is designed to be held by and on behalf of or for any person other than the applicant, the applicant for such permit shall file with the chief of police a communication in writing from the person proposing to hold the parade, authorizing the applicant to apply for the permit on his or her behalf.

(b) Proposed alternatives. If the proposed rally, meeting, or parade does not comply with rules and regulations for city parks or rules and regulations for parades and nonvehicular use of streets, the police chief or the director of parks and open space may propose alternative locations, times, routes, or other conditions. The applicant can either accept the police chief's or parks and open space director's changes or submit a new application that does comply with the issues raised by the police chief or director of parks and open space.

(c) Permit issuance. Upon compliance with this section, a permit shall be issued by the chief of police for a parade or by the director of parks and open space for use of other public property. In the case of a parade or other use of public roadway, the applicant/sponsor shall also comply with the provisions contained in section 146-207 relating to the issuance of a special use permit by the city manager.
