(a) Public and private places. It shall be unlawful for any person to make, continue, or cause to be made or continued any unreasonably loud or unusual noise which seriously inconveniences other persons in the area. For purposes of this section, a member of the police department is empowered to make a prima facie determination as to whether such noises constitute a public nuisance.

(b) Schools and hospitals. It shall be unlawful for any person by himself or herself or in the operation of any instrument, machine or vehicle to make any unnecessary noise within 150 feet of any hospital or other institution reserved for the sick, or any school during school hours.

(c) Acts of another. It shall be unlawful to permit another to commit an act of disturbing the peace as described in subsections (a) and (b) of this section in or upon any premises owned, possessed or under his or her management or control when it is in his or her power to prevent such an act.

(d) Offensive conduct or language. It shall be unlawful for any person to disturb the peace of others by violent or offensive conduct or by profane, obscene or offensive language calculated to provoke a breach of the peace.

(e) Restrictions. The restrictions of this section are cumulative and notwithstanding the requirements found in chapter 146 of this Code. (Code 1979, § 27-67)
