(a) The size of each manufactured housing space created prior to January 1, 1997, is hereby declared a legal nonconforming use for the life of the park, provided, however, that such space shall never be reduced in size. Each manufactured housing space created after January 1, 1997, shall contain a minimum of 3,600 square feet, shall be at least 30 feet wide, and shall abut on a driveway having access to a public or private street. Each space shall be clearly defined, and each unit shall be parked in such space in compliance with the setback and separation requirements herein.

(1) There shall be not less than ten feet between the sides of any two units, eight feet between the side of any unit and the end of any other unit, and six feet between the ends of any two units.

(2) No unit shall be located within ten feet from the exterior boundary of the manufactured housing park, except that all existing setbacks as of January 1, 1997, are hereby granted legal nonconforming status for the life of the park.

(3) Accessory structures, including but not limited to carports, covered patios, porches, room additions, and storage sheds, shall not be located within five feet of any structure on an adjacent manufactured housing space; except that no accessory structure consisting of noncombustible materials on a nonpermanent foundation shall be located within three feet of any structure on an adjacent manufactured housing space; and provided that all otherwise lawful noncombustible storage sheds on permanent foundations in existence as of January 1, 1997, and all otherwise lawful noncombustible unenclosed carports in existence as of January 1, 1997, are hereby granted legal nonconforming status for the life of those structures, all accessory structures must be maintained in good repair.

(4) Storage sheds may be located in a rear yard or up to the midpoint of a side yard, but shall in no event occupy more than 50 percent of the total yard area. No storage shed shall be more than eight feet in height. A maximum of two storage sheds, not to exceed 120 square feet in total or combined size, are allowed per site. On corner sites, sheds may not be placed in the front yard or on a side yard which abuts a street or access road.

(5) No fence located on any manufactured housing space between the main door or entryway of the manufactured housing unit and the nearest street or access road shall exceed 42 inches in height, provided that any otherwise lawful fence in existence as of January 1, 1997, is hereby granted legal nonconforming status for the life of the fence.

(6) It shall be unlawful for any part of the manufactured housing unit to obstruct any roadway or walkway.

(b) It shall be unlawful to allow any manufactured housing unit to remain in a manufactured housing park unless a space as set forth in this section is available.

(c) If prior to January 1, 2007, any individual manufactured housing unit is removed from its current space, the space shall not be occupied with another manufactured housing unit unless such unit conforms to the requirements of this chapter and a permit is issued therefor. Where there are unique, unnecessary and unreasonable hardships in the way of carrying out the strict letter of the requirements of this section, a manufactured housing park owner may apply to the board of adjustment for a variance from the requirements of this section. A separate variance is required for each individual unit or space. For purposes of this section, "unique, unnecessary and unreasonable hardship" specifically does not include solely financial impact on the manufactured housing park owner in complying with the requirements of this chapter.
