The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Acceptable similarity standard means a list of criteria enumerated in article III of this chapter which must be satisfied by manufactured housing on permanent foundations not within manufactured housing parks.

Accessory structure means an attached or detached subordinate structure located on the same lot with the principal building, the use of which is customary and incidental to the use of the principal building.

Building front means that portion or face of the manufactured housing unit usually facing the street or access road, although not necessarily or solely intended to incorporate the main entrance of the manufactured housing unit. Building front, for manufactured housing on nonpermanent foundations as specified in article II of this chapter, shall be the narrowest dimension of the unit.

Downcast lighting means on-site illumination which is constructed, located and aligned in such a manner as to restrict the cone of illumination to ground surface areas within the boundaries of the site, and to prevent such illumination sources from being visible from abutting properties and public streets.

Garbage means any and all rejected or waste household food, offal, swill, kitchen refuse, and every refuse accumulation of animal, fruit or vegetable matter, liquid or otherwise, that attends the preparation, use, cooking and dealing in or storing of food, or meat, fish, fowl, fruit or vegetable.

Manufactured housing or manufactured home or manufactured unit means single-family detached housing that is partially or entirely manufactured in a factory and is installed on an engineered permanent or nonpermanent foundation, and shall, for the purposes of this chapter, incorporate structures known as manufactured homes or mobile homes without further restrictions as contained in C.R.S. § 31-23-301(5).

Manufactured housing lot means a plot of ground within a manufactured housing park designed for the accommodation of one single-family detached manufactured housing unit together with its accessory uses.

Manufactured housing park, referred to in this chapter as "park," means an area of land having undivided individual, joint or common ownership, where two or more manufactured housing units are located for dwelling purposes on nonpermanent foundations as regulated in division 2 of article II of this chapter.

Manufactured housing space means a plot of ground within a manufactured housing park designed for the accommodation of one single-family detached manufactured housing unit together with its accessory uses.

Mobile home means manufactured housing built on a chassis which is designed to be installed on temporary foundations, attached to the ground with tiedown straps, and attached to natural or propane gas distribution piping, electrical distribution wiring, and plumbing waste sewer lines on a mobile home pad specifically designed with such attachment points and falling within either classification number 1 or number 2 below. A mobile home shall be construed to remain a mobile home, subject to all regulations applying thereto, whether or not wheels, axles, hitch, or other appurtenances of mobility are removed and regardless of the nature of the foundation provided. Travel and camping trailers or other form of self-powered recreational vehicle shall not be construed to be a mobile home. Mobile homes shall be classified into one of the two following classifications:

(1) Pre-1976 mobile home: Mobile homes manufactured prior to 1976 which have a permanently affixed State of Colorado inspection certification plate.

(2) 1976 and later mobile home: Manufactured housing built on a chassis with label attached certifying compliance with the "National Manufactured Housing Construction and Safety Standards Act of 1974", 42 U.S.C. Section 5401, et seq., as amended (commonly referred to as the "HUD Code").

Outdoor storage means the placement or deposit of any equipment, furniture, machine(s), material(s), merchandise, supplies, tools, or other item(s) in an outside location or outside an enclosed structure, except objects that are customarily placed outside and clearly incidental and commonly associated with the permitted use.

Rubbish or Debris means an accumulation of waste or refuse, including but not limited to rejected animal, mineral or vegetable matter, manure, ashes, wastepaper, cans, bottles, broken china, sawdust, leaves, grass cutting, shrubbery and tree trimmings, shavings and packing material, weeds, partially wrecked, junked or discarded vehicles, and appliances, or parts thereof, which are not or cannot be used for their intended purposes, sweepings, liquid or chemical waste, or any other waste material, including construction or demolition wastes.

Site means a parcel of land occupied or capable of being occupied by one building, and the accessory structure(s) or uses customarily incidental to it, including open spaces.

Storage shed means an enclosed detached accessory structure designed and used for the storage of equipment, furniture, machines, materials, merchandise, supplies, or tools.

Structure means anything constructed or erected that requires a fixed permanent or nonpermanent location on the ground or the attachment to something having a fixed permanent or nonpermanent location on the ground.

Yard means that portion of a site not occupied by a structure or structures housing the principal and accessory uses.

Yard, front means the open space on the same site with a building or unit and every point on the front of such building or unit and that open space of the site to the edge of a sidewalk or access road, and extending the full width of the site.

Yard, rear means the open space on the same site with the building or unit between the rear line of the building and extending the full width of the site.

Yard, side means the open space on the same site with the building or unit situated between the building or unit and the side line of the site and extending from the front yard to the rear yard. (Code 1979, § 24-1; Ord. No. 96-61, § 1, 12-16-1996)
