Sec. 86-86. Definitions.
Except as otherwise indicated by the context, the following words and phrases shall have the following meanings for purposes of this division:
Business means any lawful business, trade, occupation, profession, avocation, or calling of any kind having a fixed or transitory situs.
Engaged in business means to carry on or take part in the operation of a business as owner, operator, independent contractor, or agent.
The term "engaged in business" does not include:
(1) Any person who owns commercial or residential real property offered for lease or rent in the ordinary course of business that does not employ one or more employees who perform any services or other activities within the City in relation to the lease, rental, operation, or maintenance of such property for any period of time in a calendar month.
(2) Any homeowners' association that does not employ one or more employees who perform any services or other activities within the City in relation to the operation or maintenance of such association and its property for any period of time in a calendar month.
For purposes of this definition, the term "employee" shall have the same meaning as ascribed to it by section 130-401.
General business means any business which is intended to be carried on or engaged in by any person for a period in excess of 180 consecutive days.
Seasonal business means any business which is intended to be, and is in fact, carried on or engaged in by any person for a period not to exceed 180 consecutive days.
Temporary retail business means any business which consists, in whole or in part, of making retail sales as defined in section 130-31, which is intended to be, and is in fact, carried on or engaged in by any person for a period not to exceed seven consecutive days.
Temporary retail event means an event where retail sales as defined in section 130-31 are made by one or more temporary retail businesses, which event occurs for a period not to exceed seven consecutive days. (Ord. No. 2003-19, § 1, 5-12-2003; Ord. No. 98-86, § 3, 11-30-1998)
