(a) If, after investigation, the licensing administrator finds, in addition to the findings required by section 86-35, that:

(1) The individual applicant, or each of the officers, directors, managers, partners, members, and/or principal owners of the applicant, and the applicant's business manager are 21 years of age or older; and,

(2) The individual applicant, or each of the individual officers, directors, managers, partners, members, and/or principal owners of the applicant, and the applicant's business manager have not been convicted of any criminal act involving the use of or traffic in narcotic drugs, sexual abuse or assault, or violence against persons or property, or connected with the operation of another after-hours club or teen club, within ten years preceding the date of the license application,

Then he or she shall, within 30 days following receipt of the license application, approve the issuance of an after-hours club or teen club license to the applicant for use at the location identified in the license application as the situs of the business.

(b) The licensing administrator shall be empowered to place reasonable conditions and restrictions upon any after-hours club or teen club license. The licensee shall have the right to a hearing before the director to review any such conditions or restrictions in accordance with the provisions of section 86-55(a).

(c) No after-hours club or teen club license shall be issued by the licensing administrator after approval of a license application until the building or structure in which the after-hours or teen club is to be located is ready for occupancy, and then only after inspection of the premises has been made by the building division to determine that the applicant has complied with the interior building plans and specifications and architect's drawing submitted upon application.

(d) If, after investigation, the licensing administrator finds, in addition to the findings required by section 86-35, that:

(1) The applicant is 21 years of age or older; and

(2) The applicant has not been convicted of a criminal act specified in subsection (a)(2) of this section.

Then he or she shall, within 30 days following receipt of the license application, issue a manager's license to the applicant. (Ord. No. 98-86, §§ 12, 13, 11-30-1998)
