(a) Where any vehicle carrying hazardous material or hazardous waste is involved in a motor vehicle accident with another motor vehicle, a stationary object, or by itself, the operator shall immediately notify the fire department as to the location of the accident. If the driver is incapable of doing so because of injuries received or has failed to do so, the first arriving police officer shall notify the fire department as to the accident. Notification of the fire department by an operator as to an accident shall not relieve the operator of also notifying the police department as to a motor vehicle accident.

(b) If any hazardous materials, hazardous waste, or hazardous substances are spilled, discharged or released within the city without a permit, the fire department shall be immediately notified. The following information is necessary for proper notification under this subsection:

(1) Location of the spill, discharge or release.

(2) Proper shipping name of the materials, waste, or substances involved.

(3) Amount of materials, waste, or substances involved.

(4) Any information that is available concerning the hazardous materials, hazardous waste, or hazardous substances; specifically the toxicity, flammability or reactivity of the materials, waste or substances involved.

(5) Any other information available that may affect either the cleanup of the materials, waste, or substances, or the health or safety of the individuals in or around the spill, discharge or release. (Code 1979, § 16-40; Ord. No. 2005-12, § 124, 4-11-2005)
