The city attorney is authorized to institute suit in the municipal court, or other competent court of record, to abate any nuisance at common law or as enumerated in section 62-26. When judgment shall be rendered against any person for creating, keeping or maintaining any nuisance, it shall be the duty of the court before whom such conviction is had to order the defendant in such suit to forthwith abate the nuisance, and, also, if the abatement is not done by such defendant within 24 hours, the nuisance shall be abated and removed by the chief of police. The order shall be entered upon the docket of the court and shall be made a part of the judgment in the cause. (Code 1979, § 26-3)
