Appropriate court action shall mean an action brought pursuant to the provisions of Article 40 of Chapter 13 of the Colorado Revised Statutes, or, when appropriate, an action brought pursuant to Section 8-4-127 of the Colorado Revised Statutes.

Criminal negligence shall be defined as when a person, through a gross deviation from the standard of care that a reasonable person would exercise, fails to perceive a substantial and unjustifiable risk that a result will occur or that a circumstance exists.

Encourage shall be defined to include any of the following concepts: to instigate or to incite to action; to give courage to; to inspirit; to embolden; to raise confidence; to help; to forward; to advise; to entice; to aid and abet.

Good faith shall be defined as an honest and sincere effort to complete an act. It shall be taken to mean the equivalent of a person's best efforts. It shall encompass the concept of honesty of intention. It shall preclude intention to defraud or to seek unconscionable advantage.

Knowingly shall be defined to include the concept of what an objective, reasonably cautious person would have known under similar circumstances.

Owner of record shall mean the person, persons, corporation, partnership, or other legal entity appearing on the real property assessment for general (ad valorum) taxes with the county in which the property is situated.

Permit shall be defined as: to suffer, allow, consent, let; to give leave or license; to acquiesce; or to expressly assent or agree to the doing of an act.

Property occupant shall be defined to include paying tenants, all members of the tenant's immediate family who routinely occupy the property as their primary residence, all employees of the tenant whose employment requires their presence at the property, all persons residing at the property as a condition of their employment or who derive their occupancy rights as compensation for their employment; and shall include the property owner, his family, and/or their employees, if they self-occupy the property.

Property owner shall be defined to include the owner of record as well as any property managers, property management companies, or any agents or employees having authority to oversee activities at the property including those persons having authority to lease or sublease units of the property or to collect rent from leaseholders at the property.

Recklessly shall be defined as when a person consciously disregards a substantial and unjustifiable risk that a result will occur or that a circumstance exists.

Repeatedly shall be defined as at least two separate instances in any one-year period. (Ord. No. 2005-12, § 110, 4-11-2005; Ord. No. 99-19, § 1, 7-12-1999)
