The finance director is hereby designated as the local licensing authority for the purpose of regulating and controlling the licensing and sale of alcohol beverages in the city. The finance director will designate one or more hearing officers to perform the functions of the local licensing authority. The finance director shall appoint a professional hearing officer when:

(1) The finance director determines there is sufficient evidence or probable cause to believe:

a. The licensee should show cause why their liquor license should not be suspended or revoked for a violation of the Colorado Beer Code, the Colorado Liquor Code, the liquor special events permit code or of any of the rules and regulations adopted pursuant thereto by the licensee or any employee or agent of the licensee;

b. The applicant or licensee may not be of good moral character; or

c. The renewal of a liquor license may be denied for good cause.

(2) The finance director is aware a party of interest opposes the issuance of a new liquor license or a special event permit and the opposition is based on a determination of the needs and desires of the relevant neighborhood.

(3) The finance director is aware that sufficient grounds appear to exist, based on the petitions and remonstrances submitted by the applicant, or other evidence known to the finance director, the reasonable requirements of the relevant neighborhood are currently being met or the adult inhabitants of the relevant neighborhood do not desire the issuance of the new liquor license.

(4) The finance director is aware the issuance of a new liquor license, the transfer of a license, or the renewal of a liquor license may be in conflict with a provision of the Colorado Beer Code, the Colorado Liquor Code, the liquor special events permit code, any of the rules and regulations adopted pursuant thereto, or of any provision of the City Code.

(5) The finance director determines the public interest would be better served by a professional hearing officer conducting the public hearing on the application. (Code 1979, § 8-31; Ord. No. 2016-63, § 7, 12-5-2016; Ord. No. 97-43, § 2, 8-18-1997)
