(a) No cabaret license shall issue unless the premises for which the application has been made shall have a dance floor with a minimum area of 210 square feet and a minimum seating capacity of 60 guests, exclusive of the dance floor area.

(b) Any business in existence and subject to the provisions of this section on May 30, 1972, which does not conform thereto, is declared to be a nonconforming use. Any nonconforming use as defined in this section shall not be denied a cabaret license by virtue thereof so long as there is no abandonment of use, change of use, change of location of the dance floor, decrease of the dance floor, decrease of seating capacity or nonuse of the dance floor for a period of one year. After issuance of the initial cabaret license to a nonconforming user, upon the happening of any one of the events stated in this subsection, every applicant having such original nonconforming use shall comply with this section.
