Sec. 58-32. Penalty.
Any person who shall be convicted or has pled guilty to a violation of this article shall be fined in accordance with the following schedule:
(1) Upon the first conviction within a calendar year, the municipal court judge shall be empowered to assess a fine of $15.00.
(2) Upon the second conviction within a calendar year, the municipal court judge shall be empowered to assess a fine of $30.00.
(3) Upon the third conviction within a calendar year, the municipal court judge shall be empowered to assess a fine of $45.00.
(4) Upon a fourth conviction within a calendar year and every one thereafter, the municipal court judge shall be empowered to assess a fine in a sum not to exceed $300.00.
(5) No jail sentence shall be imposed for any violation of this article. (Code 1979, § 27-142)
