(a) Purposes. The city council finds and declares that the purposes of this article are to:

(1) Encourage the construction of owner-occupied, multi-family developments in the City;

(2) Facilitate the implementation of the City's comprehensive plan and zoning ordinance, both of which contemplate owner-occupied, multi-family developments in transit-oriented development districts and throughout the City;

(3) Reassure homeowners that construction defects will be promptly investigated and addressed by builders;

(4) Encourage prompt and voluntary correction of construction defects that may constitute violations of the City's building code in order to enhance the health and safety of residents of the City;

(5) Motivate all parties to resolve disputes involving construction defects quickly to avoid the need for expensive and time consuming litigation;

(6) Provide homeowners in communities with homeowners' associations with an enhanced opportunity to participate in the governance of their community by empowering individual owners to give or withhold their informed consent with respect to actions the board of the homeowners' association may desire to pursue regarding construction defects.

(b) Applicability. The provisions of this article shall apply only to new construction commenced after the effective date hereof. (Ord. No. 2015-35, § 1, 9-14-2015)
