(a) Under this article, every owner, in addition to being responsible for maintaining his or her building in a sound structural condition, shall be responsible for keeping that part of the building or premises which he or she controls in a clean, sanitary, and safe condition, including the shared or public area in a building containing two or more dwelling units.

(b) Every owner shall, where required by this article or applicable health laws, supply and maintain such approved sanitary facilities as required and shall furnish and maintain approved devices, equipment, or facilities for the prevention of insect and rodent infestation and, where infestation has taken place, shall be responsible for the extermination of any insects, rodents, pests or vermin where such extermination is not specifically made the responsibility of the occupant by law or ruling.

(c) Every owner or occupant of a dwelling unit shall be responsible for keeping in a clean, sanitary and safe condition that part of the dwelling or dwelling unit or premises which he or she occupies or controls and shall dispose of all his or her rubbish, garbage, and other waste in such a manner as required by chapter 114 of this Code.

(d) Every owner or occupant shall, where required by this article or applicable health laws, furnish and maintain approved devices, equipment or facilities necessary to keep his or her premises safe and sanitary and habitable.

(e) Every occupant of a dwelling unit shall keep all plumbing therein in a clean and sanitary condition and shall be responsible for the exercise of reasonable care in the proper use and operation thereof.

(f) Every occupant of a dwelling containing a single dwelling unit shall be responsible for the extermination of any insects, rodents or other pests therein or on the premises, and every occupant of a dwelling unit in a dwelling containing more than one dwelling unit shall be responsible for such extermination whenever the dwelling unit is the unit primarily infested. Notwithstanding other provisions of this section, whenever infestation is caused by failure of the owner or operator to maintain a dwelling in a ratproof or reasonably insectproof condition, extermination shall be the responsibility of the owner and operator. Whenever infestation exists in two or more dwelling units, extermination thereof shall be the responsibility of the owner or operator.

(g) No person shall occupy or let a dwelling unit to another for an occupancy which is not authorized or permitted under the zoning laws of the City as set forth in chapter 146. (Ord. No. 2006-78, § 1(Exh. A), 1-8-2007)
