Sec. 22-136. Experimental structures.
Section 104.2 of the IBC "Applications and Permits" adopted in section 22-131 is amended by adding the following subsection (b):
104.2 Applications and permits.
(b) Upon the written authorization of the city manager, the building official is authorized to exempt from permit requirements experimental structures constructed within a designated research and experiment area subject to the following conditions:
1. Location and extent of research and experiment area is approved by the city manager;
2. No occupancy of the experimental structure is permitted;
3. Compliance with applicable OSHA requirements;
4. Structure is located in a secure fenced area with access limited only to staff and invited guests of the experimenter, with posted signs stating access restrictions;
5. Structure shall be setback from boundary of the research and experiment area not less than one and one-half times the height of the structure;
6. Compliance with hazardous material storage and reporting requirements as determined by currently adopted International Building Code and International Fire Code, except as waived or modified in accordance with said codes;
7. Plans, diagrams, and specifications, for experimental structures shall be filed with life safety section of the building division;
8. Compliance with the National Electrical Code as adopted by the State of Colorado, except as exempted or modified by the state electrical board or the City;
9. Insurance policy in an amount determined by the city manager, naming the City as additional insured;
10. Indemnification of city, its officers, agents, and employees;
11. Each research and experiment area shall have an approved Knox cabinet located at the primary vehicle entry gate to the site. The Knox cabinet shall contain keys to all structures, a current site plan, an up to date listing of the amounts of hazardous materials with applicable MSDS sheets, emergency electrical and mechanical shut-down procedures with applicable diagrams;
12. The exemption from a building permit granted herein shall not exempt any person from the requirement to pay a use tax deposit to the City as required by City Code section 130-61.
Experimental structure shall mean an uninhabited structure erected as part of an experiment or research program.
Experiment shall mean a test under controlled conditions made to demonstrate a known truth, examine the validity of a hypothesis, or determine the efficacy of something previously untried.
