The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Art district means a commercial area that, as a result of the concentration of artists and art-related businesses and the availability of artistic programming and events within the area, attracts consumers to shop and spend time within its boundaries.

Art gallery means any building or structure in which 100 percent of the space is used by an artist or art-related business to display and sell art.

Art-related business means an individual or entity that is or intends to be engaged in a lawful business in the Original Aurora Arts District, whether for-profit or not-for-profit, that has or anticipates having no less than 75 percent of its annual gross income generated by one or more of the following products or services:

(1) Visual and/or performing arts lessons.

(2) Display and/or sale of art.

(3) Supplies used by visual and/or performing artists for the purpose of creating, displaying, or selling their work.

(4) Grants and donations dedicated to support of the visual and/or performing arts.

Art studio means any building or structure in which 100 percent of the space is used by an artist or artists to create, display, perform, or teach their medium of art.

Artist means an individual who is able to present to the city sufficient proof of compliance with either or both of the following criteria:

(1) Such individual has produced and sold any visual or performing art or provided, for a fee, lessons in any visual or performing art within the preceding twelve-month period. Proof of compliance with this requirement shall reflect the art medium that such individual intends to pursue within the arts district and may include any of the following:

a. A municipal license for an art-related business;

b. Sales receipts;

c. Billing for participation in artistic performances;

d. Proof of participation in art exhibits or fairs; or

e. Other proof of compliance satisfactory to the City.

(2) Such individual has earned a post-secondary degree in any visual or performing art from an accredited university, college, or institution of higher learning.

Artist live/work space means any building or structure in which no less than 50 percent of the space is used by an artist or artists to create, display, perform or teach their medium of art, with the remainder of the space used exclusively as the personal residence of one or more of said artists.

Developer of art-related space means an individual or entity that is seeking to construct or renovate a building or structure in the Original Aurora Arts District, of which 100 percent of such building or structure will be sold or leased to, and used by, artists or art-related businesses.

Original Aurora Art District means that area within the city which is bounded by Clinton Street to the west, East 16 th Avenue to the north, Geneva Street to the east and East 14 th Avenue to the south. (Ord. No. 2002-08, § 2, 2-25-2002)
