(a) It shall be unlawful for any person to cause or contribute to a violation of the city's NPDES stormwater discharge permit.

(b) Notwithstanding any provision of this article to the contrary, if assessed a penalty for any violation of its NPDES stormwater discharge permit, the city shall have the authority to recover civil penalties from or impose criminal penalties against any person who is found to have caused or contributed to such violation in an amount equal to the penalty assessed against the city.
