Sec. 138-297. Legal action.
If any person discharges sewage, industrial wastes or other wastes or similar substances into the POTW contrary to any provision of this article, any order, rule, regulation, or permit issued under this article or any federal or state pretreatment standards or requirements, the general manager, in addition to any other remedies or actions, may:
(1) Direct the city attorney to commence an action for appropriate legal and equitable relief in any county or district court having jurisdiction of the subject matter of the action and the amount, if any, sought to be collected; and
(2) Institute criminal proceedings in the municipal court in and for the city through the issuance of a municipal summons and complaint to the offending party pursuant to the authority granted him or her by section 50-30.
