(a) It shall be unlawful for any person to construct, remodel or install any nonmunicipal waste disposal system within the corporate boundaries of the city without first making application to and obtaining a permit from the health officer.

(b) At such time as a public sewer becomes available to a property served by a nonmunicipal waste disposal system as provided in subsection 138-259(c), a direct connection shall be made to the public sewer in compliance with this article, and any septic tanks, cesspools and similar nonmunicipal waste disposal facilities shall be abandoned, cleaned of sludge and filled with suitable material.
