(a) Where it appears doubtful that a person will appear pursuant to a written summons and complaint for a traffic offense, the violator may be kept in custody by the police department unless lawfully released on bond, until trial, or until he or she has complied with the penalty imposed by the court, as the case may be.

(b) Any police officer, having determined that there is probable cause to believe that a traffic violation has occurred, shall, whenever possible, take the name, address, and driver's license number of the alleged violator and the license number of the vehicle involved, and shall issue to him or her a summons and complaint to answer to the charges against him or her at a place and at a time so designated.
