(a) The possible penalties set forth in sections 1-13 and 134-361 of this Code shall not apply to any traffic violation detected by the use of any automated vehicle identification system. Any traffic violations detected by the use of an automated vehicle identification system shall be subject to the following penalties and costs upon entry of judgment against the defendant:

(1) If the violation involves the disobedience to any traffic control device, the maximum penalty that may be imposed for such violation is $75.00.

(2) If the violation does not involve disobedience to any traffic control device, the maximum penalty for such violation is $40.00.

(3) If the violation occurs within a school zone, the maximum penalty that may be imposed shall be twice that as set forth in subsections (1) and (2) herein, as may be applicable.

(4) Regardless of the nature of the violation, the court is authorized to impose additional costs, not to exceed $40.00, for service of process upon any defendant to obtain personal jurisdiction over the defendant who did not waive service of process. (Ord. No. 2005-05, § 1, 2-28-2005)
