(a) It shall be unlawful for any person to drive from a public street or public way of the city over, across or through any private property or driveway to avoid traffic control signals, stop signs, or other traffic control devices or as a route or short cut from one public street or public way to another.

(b) As used in this section, "private property" includes, but is not limited to, any property not dedicated as a public street or public way, alley, right-of-way or easement.

(c) It shall be an affirmative defense to a charge of a violation of this section that the person charged is the owner of the property or driveway through or across which the motor vehicle is driven, or of leasehold or easement rights therein or the right to the possession or use thereof.
