The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Muffler means a device consisting of a series of chambers or baffle plates, or other mechanical design for the purpose of receiving exhaust gas from an internal combustion engine and effective in reducing noise.

Operate means to ride in or on and control the operation of an off-highway vehicle while the vehicle is being self-propelled.

Operator means every person who operates or is in actual physical control of an off-highway vehicle.

Off-highway vehicle means a self-propelled wheeled or tracked vehicle primarily designed to be operated for recreational purposes on land or water, other than roads or highways, and includes those motorcycles more commonly known as dirt bikes. Off-highway vehicle does not include self-propelled golf carts which are used exclusively upon golf courses. Exception: A properly licensed, registered and street equipped off-highway vehicle may be operated on the highways and streets of the City. (Code 1979, § 37-72; Ord.
