The city council finds and determines that the operation of an off-highway vehicle constitutes a hazardous condition on public rights-of-way and constitutes a noise nuisance and for these reasons it is necessary, in order to protect the health, welfare and safety of the residents of the City, that reasonable regulations be promulgated to permit the operation of such off-highway vehicles in prescribed areas only and to further regulate the hours of operation of such off-highway vehicles and the equipment required to be used during their operation. The provisions of this article shall be applicable throughout the City on both private property, public rights-of-way and publicly owned facilities. (Code 1979, § 37-71; Ord.
