Upon the request of a member of the police department or director of public works the vehicle subject to this article shall be towed to a storage facility. The owner of the towing equipment and storage facility shall be authorized to assess a fee set by contract with the city for services rendered, and such costs shall constitute a lien upon the vehicle. If after 30 days the owner or lienholder fails to reclaim the vehicle by paying the appropriate towing costs and storage fees, the police department is authorized to sell, at a public auction or private sale, the abandoned vehicle. However, prior to public auction or private sale, the police department or director of public works shall attempt to notify any lienholder of the contemplated sale. A list of the vehicles to be sold at public auction sale shall be published in a newspaper of general circulation not less than 30 days before the sale. (Code 1979, § 37-42; Ord.
