The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Abandoned vehicle means a vehicle or trailer upon a street or highway which has not been moved, pursuant to section 134-10, for three days; and (i) is apparently inoperable due to the mechanical condition of the vehicle, or (ii) is in such a condition that the vehicle could not be legally or safely driven or moved upon the roadway; or has remained standing and unattended on a street or highway for seven or more consecutive days or upon a controlled access highway for three hours, in the same location, regardless of the condition of the vehicle. This subsection shall not apply to a vehicle standing in front of the registered owner's residence, unless (i) or (ii) applies herein.

Complainant means the owner or lessee of real property within the City. However, if a lessee is presently a tenant in a multiunit complex, which has a person assigned by the owner to manage the property, the manager and not the tenant shall be the complainant.

Director of public works means the director of public works or designee.

Discarded vehicle means a vehicle that has been left upon private property, which the complainant desires to have removed.

Impoundment means the removal of the vehicle to a facility which by prior arrangement with the police department or director of public works shall accept such vehicles as have been ordered to be removed by a member of the police department or by the director of public works.

Owner means the person to whom the vehicle is registered according to the records of the state motor vehicle division.

Private property means any property within the city which does not have the city indicated as the owner by the public records. (Code 1979, § 37-37; Ord. No. 2016-34, § 4, 8-8-2016)
