(a) The terms and conditions of any incentive provided by the city for the creation of jobs shall be set forth in a written agreement between the city and the taxpayer, approved by resolution of the city council, and executed by the mayor and city clerk. At a minimum, each such agreement shall provide that:

(1) The taxpayer shall submit evidence reasonably acceptable to the City of the creation of new jobs within the City at the salary level required by this article and of the maintenance of said jobs and salaries throughout the term of the agreement;

(2) The taxpayer shall submit building permits, invoices, or other evidence reasonably acceptable to the City of the payment of all taxes to be rebated under the agreement by the taxpayer or its contractors, subcontractors or suppliers to the City or any person or entity authorized to collect such taxes on behalf of the City;

(3) The taxpayer shall agree to use reasonable efforts to recruit new employees from residents of the city and to encourage non-resident employees to establish residency within the City;

(4) The taxpayer shall warrant to the city that its business shall be in compliance with all applicable zoning and other federal, state, county, and city statutes, rules, regulations, and ordinances; and

(5) Sanctions shall be imposed in the event that the taxpayer fails to meet its obligations under the agreement, including but not limited to termination of the agreement and reimbursement of all or a portion of the taxes rebated and payments made by the city with reasonable interest thereon. In addition, procedures and remedies shall be provided for the purpose of enforcing these sanctions, including but not limited to the imposition of liens upon real and personal property of the taxpayer.

(b) Any decision as to whether to enter into an agreement to provide an incentive for the creation of jobs shall be made at the sole discretion of the city council. In addition, the term of any such agreement shall be as determined by the city council no such agreement shall be entered into by the city pursuant to this section prior to the approval of such agreement by the city attorney as to form.
