(a) Proceeds from the lodger's tax in an amount equal to 12.5 percent of the total lodger's taxes received by the city during the last preceding fiscal year for which complete data is available may be expended for the purpose of advertising, marketing, and promoting the City as a quality destination for shopping, dining, lodging, and other related activities.

(b) Notwithstanding anything in this section to the contrary, the city council may reduce the annual allocation of lodger's tax proceeds for the purposes set forth in subsection (a) of this section where, during the annual budget process, it determines that a lower contribution level is warranted.

(c) In any fiscal year where actual lodger's tax revenues exceed $5,000,000.00 in the annual budget for that year, then, in addition to the amount designated by subsection (a) of this section, the city council may allocate all or any portion of such excess lodger's, as determined by council for the purposes set forth in subsection (a) of this section.
