The public works department, acting by and through its inspection services division, shall enforce all of the provisions found in this article.

(1) It shall be unlawful for any owner to maintain overhead electric distribution lines in any location where the director has ordered the underground relocation of electric distribution lines under the authority of the City's electric utility franchise agreement, and such electric distribution facilities have in fact been relocated underground.

(2) It shall be unlawful for any owner to maintain overhead telecommunications lines or telecommunications facilities in any location where the director has ordered the owner to relocate underground or remove the overhead facilities in accordance with section 126-506 of this article.

(3) Any owner found in violation of this section shall be subject to a fine of up to $2,650.00 per day for each day in which the overhead electric distribution lines or overhead telecommunications lines or telecommunications facilities remain in place.

In addition to the penalties in this article, the city may seek any appropriate remedy for damages or equitable relief to secure compliance with this article and to preserve the City's interest in city streets or other city property.
