(a) The contractor, together with the engineering firm and land surveyor in responsible charge of the construction survey, shall be responsible for the preservation and protection of survey monuments, including but not limited to benchmarks, block corners, range points, section corners (all aliquot corners), accessories and tie points to aliquot corners.

(b) The contractor shall make every reasonable effort to preserve and protect survey monuments during the course of construction. If the destruction or obliteration of a survey monument is unavoidable, the contractor shall immediately, prior to commencement of work, notify the engineering firm or land surveyor in charge of the construction survey and shall further advise the city chief of surveys that such notification has been made.

(c) Prior to commencement of work, the engineering firm or the land surveyor in responsible charge of the construction survey shall make such measurements and set such physical points as necessary to preserve the location of the survey monument to be destroyed or obliterated. The date so obtained shall be made available to the city chief of surveys.

(d) The engineering firm or land surveyor in responsible charge of the construction survey shall be responsible for the accurate and timely reestablishment of each survey monument destroyed or obliterated by construction work and shall notify the city chief of surveys at such time the survey monument is reestablished.

(e) Reestablishment of section corners (all aliquot corners) shall be made in accordance with the provisions of C.R.S. § 38-51-102(13), as amended.

(f) Reestablishment of city survey monuments shall be made in accordance with regulations of the director of public works and appropriate ordinances of the City. Such regulations and ordinances, copies of which may be obtained from the chief of surveys, apply to the methods, procedures and materials required to reestablish survey monuments within the City, except for concrete or asphalt. Such materials may be obtained from the chief of surveys.

(g) Reestablishment of survey monuments shall be made under the direction of a land surveyor registered in the state, who shall certify and file the monument records identifying such reestablished survey monuments in a manner prescribed by statute.

(h) Any person who violates any of the provisions of this section shall be subject to one or more of the following actions:

(1) Proceeding against contractor.

a. Suit upon the bond of the contractor to recover actual cost of reestablishment of destroyed or obliterated survey monuments, not to exceed the amount of $250.00 for each survey monument.

b. Revocation of existing permits and denial of further permits unless and until the survey monument has been reestablished or the cost of such reestablishment has been recovered from the contractor.

c. Suspension or revocation of the contractor's license.

(2) Proceeding against engineering firm or land surveyor in responsible charge of construction survey. Proceeding in law in accordance with the provisions of C.R.S. tit. 38, art. 51(C.R.S. § 38-51-101 et seq.) and C.R.S. tit. 38, art. 53(C.R.S. § 38-53-101 et seq.), as amended. (Code 1979, § 34-46)
