The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Contractor includes any person who engages in the business of providing labor and material for construction or repair work for others in the public right-of-way, and such term shall also include any homeowner performing such work within the public right-of-way. Such term shall not include those persons directly employed by the City.

Right-of-way means any highway, street, road or alley within the City or any public way dedicated for similar purposes, whether or not presently improved. The term "right-of-way" shall not include easements situate outside the public right-of-way as defined. In order to determine with specificity the existence and width of a particular public right-of-way, reference may be had to the map kept by the city engineer pursuant to article II of this chapter.
