(a) The improvement districts in municipalities law, C.R.S. § 31-25-601 et seq., as amended, shall govern all matters relating to general improvement districts in the City, except to the extent that the provisions of this law may differ from or conflict with any applicable provisions of the Charter or this Code.

(b) Notwithstanding any provision of state law to the contrary, no sound wall, wall, or fence shall be ordered to be constructed in any general improvement district unless a petition for the organization of the same subscribed by not less than 30 percent of the electors of the proposed district is first presented to the City.

(c) For purposes of this article, "elector of a district" means a person who, at the designated time or event, is registered to vote in general elections in this state and:

(1) Has been a resident of the district or of the area to be included in the district for not less than 30 days; or

(2) Owns, or whose spouse owns, taxable real or personal property within the district or within the area to be included within the district, whether the person resides within the district or not; or

(3) Where the owner of taxable real or personal property specified in subparagraph (2) of this subsection (c) is not a natural person, an "elector of a district" shall include a natural person designated by such owner to vote for such person. Such designation shall be in writing and filed with the city clerk of the municipality. Only one such person may be designated by an owner.

(d) Notwithstanding any provision of state law to the contrary, where the organization of a general improvement district is proposed for the primary purpose of financing the construction, installation, and maintenance of a sound wall, wall, or fence and any improvements appurtenant thereto, no commercial property shall be included within the boundaries of such district except upon petition subscribed by the owner of such property or such owner's designee.
