Any nonprofit entity, as defined in this section, shall be permitted to sell items of personal property other than those belonging solely to the owner or lessee of the premises. A nonprofit entity shall include only those persons organized for religious, charitable or education purposes. In addition, the city council shall be authorized to grant nonprofit status to any other person which it deems deserving of such status. The director of finance or designee shall make the initial determination by using this definition as to whether or not the person intending to conduct a garage sale qualifies as a nonprofit entity. The granting of nonprofit status shall not exempt the seller from complying with the requirements found in any other section in this article. The director of finance or designee having made such a determination shall issue a written statement indicating that nonprofit status has been granted to the applicant.
