Under this article, if the member who terminated his or her service subsequently returns to service as an active member, his or her prior service credit shall be restored when he or she returns his or her refunded contributions, with interest to the date of the return of the refund. If the member fails to return such contributions and five-percent interest per annum, he or she shall be treated as a "new hire," and his or her prior service shall not be recognized in determining pension eligibility or pension benefits. The board shall have the authority to establish a repayment plan for the refunded contributions through their bylaws. (Code 1979, § 15-121)
